Welcome to Podcast Press Tour (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern the relationship between Podcast Press Tour, podcast hosts (“Hosts”), and guests (“Guests”) who use or access our services, including but not limited to booking, guest appearances, and content creation (“Services”). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By using our Services in any capacity—whether as a Host or a Guest—you acknowledge that you have read, understood, and agree to these Terms. If you do not agree, please discontinue use immediately.

2. Description of Services

For Guests: We help secure appearances on carefully selected podcasts that align with your goals and audience. Beyond booking the interview, we produce marketing content (e.g., AI-generated articles, audiograms, and transcripts) that showcases your expertise and boosts your visibility. This blend of impactful podcast appearances and ready-to-use PR assets provides a comprehensive approach to enhancing your credibility and promotional reach.For Hosts: We introduce potential Guests who pay for the opportunity to appear on your podcast. Hosts may receive a nominal fee for each booked Guest and must provide Podcast Press Tour with copies of the recorded interviews so we can create marketing assets on behalf of the Guest. Hosts retain full creative control over their show content and scheduling.

3. Registration and Account Responsibilities

Eligibility: You must be at least 18 years old and capable of entering into a legally binding agreement.Account Information: All information you provide must be accurate and kept up to date. You are responsible for maintaining the confidentiality of your login credentials.

4. Payment and Compensation

Guest Fees: Guests agree to pay the fees outlined in their booking confirmation. Once Services are paid for, no refunds will be issued under any circumstances.Host Compensation: Hosts may be entitled to a nominal fee for each Guest booking, as communicated by Podcast Press Tour. Payment terms and timelines will be specified during the sign-up or acceptance process.

5. Scheduling and Content Delivery

Guest Scheduling: We coordinate dates, times, and topics with the Host on your behalf. However, final scheduling is at the Host’s discretion, and availability cannot be guaranteed.Host Obligations: Once an interview is recorded, Hosts agree to provide the raw audio or video files to Podcast Press Tour for the creation of marketing assets. Hosts retain creative control over their show but acknowledge that Guests have purchased a spot on their program.

6. Intellectual Property

Guest Content: Guests retain ownership of their personal brand, name, likeness, and any materials they create. By participating in a podcast, Guests grant Hosts and Podcast Press Tour a non-exclusive license to use, edit, and distribute any recorded content for the purposes of delivering and promoting the Services.Host Content: Hosts retain ownership of their podcast name, branding, and original content. By submitting the recording to Podcast Press Tour, Hosts grant us a non-exclusive license to use and transform the content into marketing assets on behalf of the Guest.

7. Code of Conduct

Professionalism: Both Guests and Hosts are expected to maintain professionalism during communications and recordings.Prohibited Content: Hate speech, harassment, discrimination, or illegal activity is strictly prohibited. We reserve the right to terminate access if such violations occur.

8. Cancellations and Rescheduling

No Refunds: All payments made to Podcast Press Tour are non-refundable. Once Services are paid for, no refunds will be issued under any circumstances.

Host Cancellations: If a Host cancels or fails to complete the scheduled interview and does not reschedule, Podcast Press Tour will make reasonable efforts to place the Guest on a comparable podcast at no additional charge.

Guest Cancellations: If a Guest cancels after payment has been made, Podcast Press Tour will not offer a refund. However, at our discretion, we may attempt to reschedule the Guest on another suitable podcast.

9. Disclaimers and Limitations of Liability

No Guarantee of Results: While we strive to match Guests and Hosts effectively, we do not guarantee any specific outcome in terms of audience reach, profits, or publicity. No Endorsements: We do not endorse or take responsibility for opinions expressed by either Guests or Hosts. Limitation of Liability: To the fullest extent permitted by law, Podcast Press Tour shall not be liable for any indirect, incidental, or consequential damages arising from or related to these Terms or the Services provided.

10. Indemnification

You agree to indemnify and hold harmless Podcast Press Tour, its employees, agents, and affiliates from any claims, liabilities, damages, or expenses (including attorneys’ fees) arising out of your use of the Services, violation of these Terms, or infringement of any intellectual property or other rights.

11. Modifications to Terms

We may update or modify these Terms at any time. When we do, we will revise the “Last Updated” date at the top. Your continued use of the Services after any changes indicates your acceptance of the updated Terms.

12. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law provisions. Any claim or dispute arising from or related to these Terms or the Services shall be brought exclusively in the state or federal courts located in Broward County, Florida. You consent to personal jurisdiction in these courts for the purpose of litigating such claims or disputes.
